01 · agreement

Agreement and document hierarchy

These Terms of Use (“Terms”) govern access to and use of the PhraseReplay iOS application and related services (“Service”). In these Terms, “PhraseReplay”, “we”, “us”, and “our” refer to the PhraseReplay product environment.

By downloading, accessing, or using the Service, you agree to these Terms and the Privacy Policy. Apple’s Standard Licensed Application End User License Agreement applies where relevant to an App Store licensed application and purchases. Mandatory consumer rights and Apple-controlled billing rules prevail where they cannot be waived.

What PhraseReplay provides

PhraseReplay may provide:

• Capture: user-initiated ReplayKit Live Capture, manual screenshot or Action Button capture, and related settings;
• Sessions and Moments: processing that turns selected capture inputs into segmented, searchable learning items;
• Memory and Library: saved phrases, excerpts, transcripts, reading aids, and progress;
• Replay, Path, and Practice Voice: language practice and review features;
• Notifications: optional reminders or session-ready updates; and
• Plus: paid features or limits as displayed by Apple’s StoreKit product sheet.

Features, languages, models, limits, and availability can change. The website does not promise a particular model, processing speed, or feature parity unless the current in-app offer says so.

03 · account

Eligibility, accounts, and deletion

You may use supported guest access and may link Sign in with Apple or Google where the app offers it. Keep your device and sign-in methods secure. Activity under an account may be treated as activity authorized by that account unless you notify us promptly.

You must be legally able to use the Service in your location and comply with applicable age and permission requirements.

The app provides a straightforward in-app account-deletion path. Account deletion removes account-owned server records and storage, subject only to limited legal/security backup handling described in the Privacy Policy. Deleting the app or account does not automatically cancel an Apple subscription.

04 · capture

User-initiated capture and source content

You control when a capture begins and ends through Apple ReplayKit and iOS system controls. iOS provides the system Broadcast UI and capture indication; do not attempt to hide, bypass, or defeat those controls. While an active capture is running, anything visible or audible in the selected path may be processed, including app audio, sampled screen frames/text, and microphone input only if you enable the microphone.

Only capture content you own or are authorized/permitted to process. You must respect the rules, copyright, privacy rights, and community standards of any source app or website. PhraseReplay is not affiliated with, endorsed by, or a substitute for any third-party platform. We do not grant a license to third-party source content and do not claim that an in-app setting or checkbox creates source authorization.

05 · source rights

Content rights and product limits

PhraseReplay has no URL downloader, DRM bypass, original-audio download/share/export feature, or tool for reconstructing protected third-party media. A short source-audio excerpt may be retained only as learning-context functionality tied to a Moment when that feature is enabled; it does not transfer ownership or permission in the underlying source.

Do not use PhraseReplay to download, convert, redistribute, or commercially exploit media from another service. You are responsible for having the rights or permission required for the content you choose to capture.

06 · automation

AI-generated and automated outputs

PhraseReplay may use automated systems, including Google Gemini, for speech recognition, translation, glosses, explanations, titles, coaching text, and related language tasks. Outputs may be incomplete, inaccurate, biased, delayed, unavailable, or unsuitable for your context.

Do not rely on PhraseReplay outputs as professional, medical, legal, financial, emergency, or other high-stakes advice. You remain responsible for checking translations and deciding whether to use a phrase.

07 · content

Your content and PhraseReplay IP

You keep rights you already have in capture materials, notes, and learning materials you create, subject to rights held by other people or source platforms. You grant the operator a limited, worldwide, non-exclusive license to host, transmit, process, display, and create learning outputs from your content only as needed to provide, secure, maintain, and improve the Service for you and as described in the Privacy Policy.

The PhraseReplay software, design, documentation, trademarks, and non-user materials belong to the operator or its licensors. Do not copy, sell, lease, scrape, reverse engineer, or redistribute the Service or its branding except as allowed by law or with written permission.

08 · paid features

Plus subscriptions and Apple billing

PhraseReplay Plus and any paid features are offered only as shown by the current App Store product sheet. Product names, tiers, prices, billing periods, trial eligibility, and feature value are shown by Apple’s storefront offer.

• Apple charges your Apple ID account according to the storefront offer at confirmation and for renewal.
• Auto-renewal continues unless canceled through Apple’s subscription controls at least as required by the offer and applicable law.
• Price, localized currency, taxes, trials, introductory offers, and eligibility are the StoreKit source of truth; do not rely on generic website copy.
• Manage or cancel subscriptions through Apple Manage Subscriptions; restore a purchase through the app where supported.
• Deleting the app or PhraseReplay account does not automatically cancel Apple billing.
• Refund requests are handled by Apple through its official Report a Problem flow, subject to Apple’s policies.

Material feature or price changes follow Apple’s process and applicable consumer law. These Terms do not override Apple billing rules or mandatory rights.

09 · use rules

Acceptable use and enforcement

You must not use the Service to:

• break the law, infringe copyright, invade privacy, harass, defame, impersonate, or expose another person’s confidential information;
• capture or process sensitive content you are not entitled to handle;
• attack, overload, probe, bypass security, evade rate limits, or interfere with the Service;
• use automated scraping or bulk export to build a competing dataset;
• misrepresent affiliation with Apple, Google, Vibe MKR, PhraseReplay, or another service; or
• commercially redistribute third-party source media or PhraseReplay outputs without the required rights.

We may limit, suspend, or terminate access when reasonably necessary for safety, security, legal compliance, abuse prevention, or a breach of these Terms, subject to mandatory law and any required notice or appeal.

10 · risk and legal terms

Disclaimers, liability, and governing law

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT PROMISE THAT THE SERVICE, CAPTURE, TRANSCRIPTS, TRANSLATIONS, AI OUTPUTS, OR THIRD-PARTY COMPATIBILITY WILL BE ACCURATE, COMPLETE, SECURE, CONTINUOUS, OR ERROR-FREE.

To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or loss of data, profits, or goodwill, arising from the Service. Mandatory consumer protections and other rights that cannot be limited by law continue to apply.

11 · Apple and changes

Apple-specific terms, changes, and contact

These Terms are between you and the PhraseReplay product environment, not Apple. Apple has no obligation to provide maintenance or support for PhraseReplay. Apple may be a third-party beneficiary of applicable licensed-application provisions with rights to enforce them, and Apple’s Standard EULA and App Store rules apply where relevant.

We may change the Service or these Terms. We will update the version/date and provide notice for material changes when required. If a provision is unenforceable, the rest remains effective; mandatory consumer protections override conflicting language.
